YOUR USE AND CONTINUED USE OF THE ADMIT PLATFORM AND OUR SERVICES INDICATES THAT YOU HAVE BOTH READ AND ACCEPT THESE TERMS AND CONDITIONS AND ALL TERMS AND CONDITIONS AND NOTICES INCORPORATED HEREUNDER BY REFERENCE (I.E THAT ALSO FORM PART OF THESE) (“T&Cs”), INCLUDING:
DYNAMIC RISK ASSESSMENT (DRA) and DYNAMIC ENTREPRENEURIAL ASSESSMENT (DEA)
The DRA is an assessment designed to understand your behaviour and preferences. It requires you to provide your Personal Information. WE, AX Group, explain below why and how your Personal Information will be collected, used and protected during the process. TERMS AND CONDITIONS REGARDING YOUR PERSONAL INFORMATION.
WHY is your Personal Information collected?
The purpose for collecting your Personal Information and other information in the assessment, is two-fold. Firstly, it is to enable us to explore your eligibility to be offered financial services (such as credit, insurance products etc. ) which you may otherwise not qualify for at the moment. Secondly, if/once YOU DO HAVE a credit rating, the Personal Information you provide us may be used to complement existing bureau data and other data, for the purpose to better manage your existing financial services accounts or to test your eligibility for additional financial services offerings. The Personal Information you provide will not be used or processed for any purpose other than this.
WHAT is your Personal Information?
Personal Information means information relating to YOU which can be used to personally identify you, and includes information such as your name, email address, mobile phone number, identity number, your valid DRA and DEA Result, and also information detailed in the Protection of Personal Information Act. (This Act is also known as POPIA.) Your rights regarding your Personal Information are protected by POPIA.
PROTECTING your Personal Information
When completing the Dynamic Risk Assessment or Dynamic Entrepreneurial Assessment, you will be required to provide us with certain Personal Information. The purpose of these terms and conditions is to make sure that you understand the following before you proceed with the assessment:
1. Why your Personal Information is required and provided.
2. How we, and our partners may collect, use, share, protect and otherwise handle or process your Personal Information.
3. Your rights regarding your Personal Information.
HOW may we collect, use, share, protect and otherwise handle or process your Personal Information?
If you consent to these terms and conditions, you also agree that we can share information with the organization or partners requiring you to take the DRA or the DEA (the ‘Client Organization’). With your consent, we may collect, use, share, protect, and otherwise handle your Personal Information, as long as it is done in accordance with POPIA requirements. This means that we only keep your personal information as long as it is necessary to achieve the purpose it was collected for, and only share it with the partners involved in achieving this purpose. A partial record containing some of your data may be retained for analytic, operational, or research purposes other than those explained here. This data is absorbed into large datasets used to assess and improve the DRA or DEA and the credit service extended. We therefore confirm and undertake:
· We will always handle your Personal Information in accordance with the POPIA, requirements.
· We will not use your Personal Information for any purpose other than the purpose explained above.
· We have implemented substantial security measures to protect your Personal Information in our possession from unauthorised use, disclosure, or access.
· In the event of any data breach, we will notify you.
· We have contractually agreed with our partners that all processing of Personal Information by ourselves or our partners for purposes of this assessment will always be done in compliance with POPIA regulations. We will continuously monitor this contractual obligation.
· To address any queries regarding the accuracy of your data on our system.
Our Privacy Policy confirms our commitment to POPIA and is available on request.
Your permission is required
Before you start to complete the assessment, you need to give us permission that your Personal Information may be collected and used for the above purpose. You therefore need to agree to the following:
1. You give your permission to provide your Personal Information for the purpose stated and you do so voluntarily.
2. The terms of our Privacy Policy or the privacy policy of the client organisation.
3. You give us permission to collect, use and process your Personal Information in accordance with our Privacy Policy and POPIA.
4. You give permission for the further processing of your Personal Information by the Client Organization, who may process your Personal Information for technical, operational and data analytical purposes, which will be limited to this assessment.
5. We may collect your Personal Information when you decide to take the assessment yourself, or under a mandate given by our client organisation that has requested you to complete the assessment.
6. All information you provide, all tests or assessments you complete, all assessment results and any observations made in terms of the results may be included in the Assessment Report.
7. The complete Assessment Report may be stored by the Client Organization on its system, any associated partner’s system, and/or other systems that are used by the Client Organization.
It is important to remember that participation is voluntarily. You don’t have to take this assessment (there is no penalty if you don’t) and you don’t have to provide your Personal Information. If you choose not to participate in the assessment, you don’t have to agree to points 1 - 7 above.
By continuing with the assessment, you hereby authorise the Client Organization, and give us consent to:
· Collect and use your personal information for assessment purposes (this includes storing this information safely and securely).
· Use the results for feedback purposes (this includes storing the results in any database belonging to the Client Organization.
You also agree:
· That all Personal Information provided has been provided voluntarily and specifically by you and is a true reflection of yourself.
· That you will not copy or distribute information from this assessment in any form.
· To do a subsequent verification test to confirm your assessment results, if required.
· That you understand that your rights relating to Personal Information are protected in terms of our Privacy Policy and POPIA.
· You understand that our Privacy Policy is available to read should you wish to do so.
· That you understand that once assessment results have been sent to the Client Organization and its partners involved in data processing, we can no longer control or monitor how such information is processed further. You therefore indemnify AX Group against any liability which may result from the use of your assessment information, whether related to privacy or other assessment processes.
· If you apply more than once within a 3 month period, we will use the initial assessment results, as they will still be considered valid.
· If you apply across different partners of ours within the 3 month validity period, we will share a copy of the valid results with each new partner.
